HC rejects Khaleda’s petition in graft case
A petition filed by BNP chairperson Khaleda Zia seeking cancellation of the Zia Charitable Trust graft case filed by the Anti Corruption Commission (ACC) against her was rejected by the High Court on Thursday.

An HC bench comprising Justice Ruhul Kuddus and Justice Mahmudul Huq gave the order after hearing the petition.

The court passed the rejection order considering that the petition was not submitted properly before the court.

Barrister Mahbub Uddin Khokan appeared for Khaleda Zia while Khurshid Alam Khan stood for the Anti Corruption Commission (ACC) during the hearing.

Khaleda’s counsel Barrister Mahbub Uddin Khokon submitted the petition on her behalf with the HC bench concerned citing faulty recruitment process of the investigation officer (IO) in the case.

The petition said the ACC has the right to appoint an IO in any case under section 20 (1) of ACC Act-2004.

Besides, a gazette notification should be published in this regard, it said.

The petition also sought to issue a rule asking the government why the Zia Charitable Trust graft case should not be cancelled following faulty recruitment of its IO.

On March 9, Khaleda challenged the legality of appointment of Harunur Rashid, the investigating officer of the case, saying that the Anti Corruption Commission (ACC) has not published any gazette notice.

On August 8, 2010, the ACC filed the Zia Charitable Trust graft case with Tejgaon police station accusing four people, including Khaleda Zia, of abusing power in raising funds for the trust from unknown sources.

ACC deputy director Harunur Rashid, also an investigation officer of the case, pressed charges against the accused on 16 January 2012.

The trail proceeding of Zia Charitable Graft Case is underway at the Special Judge Court-3 of Judge Abu Ahmed Jamadar, set up on the premises of Alia Madrasa in the capital’s Bakshibazar.
